Investment Requirements

The EB-5 program requires a qualifying investment in a new commercial enterprise: • Standard Investment: $1,050,000 • Targeted Employment Area (TEA): $800,000 The investment must create or preserve at least 10 full-time jobs for qualifying U.S. workers. Most investors use USCIS-approved Regional Centers, which allow indirect job creation through economic modeling.

Direct vs. Regional Center

• Direct Investment — You invest directly in your own business and must prove direct job creation. Offers more control but requires active management. • Regional Center — You invest in a USCIS-approved Regional Center project (typically real estate or infrastructure). Indirect jobs count. This is the most popular path, accounting for over 90% of EB-5 filings.

The Process Timeline

1. Source of Funds Documentation — The most critical step. I help you compile a lawful path of funds. 2. I-526E Petition — Filed with USCIS to demonstrate the qualifying investment and job creation plan. 3. Conditional Green Card — Upon approval, you receive a 2-year conditional Green Card. 4. I-829 Petition — Filed to remove conditions after demonstrating job creation. 5. Permanent Green Card — Full, unconditional permanent residency for you and your family.

Source of Funds: The Make-or-Break Factor

The number one reason EB-5 petitions are denied is insufficient source-of-funds documentation.
